The “Professional and Amateur Sports Protection Act of 1992,” known as PASPA, was one of the most controversial federal gambling statutes on the books. In Murphy v. National Collegiate Athletic Association, the Supreme Court, in a 7-2 decision that PASPA violated the 10th Amendment to the U.S. Constitution and was stuck down in its entirety.

The controversy over sports betting could now pivot from whether it was legal for states to offer sports betting, to whether they should legalize sports wagering how they should go about regulating it.

In response besides Nevada which was exempt from PAPSA, seven states Delaware, Pennsylvania, Rhode Island, New Jersey, West Virginia, New Mexico and Mississippi, have authorized sports wagering.

This discussion concentrates on a single, but significant issue. Should state-authorized sports book operators be required to share revenue with the sports leagues and athletes that they derive from sports wagering, whether they be classified as a royalty fee, an integrity fee or a data fee. The leagues support imposition of such fees. They first proposed the fees in Indiana in 2018, but no states that have authorized sports wagering have adopted them.

E-Sports: Emerging Trends and Regulation Issues & Hybrid Games: Issue of Attracting Millennials

This panel will discuss Esports as it becomes an international largely unregulated phenomenon. What are the emerging esports trends? Should esports be regulated? If regulated, by whom? What are the dangers and pitfalls? Does the November 2, 2018 Memorandum Opinion on the application of the Wire Act have an impact on online esports? These and other state of the esports industry issues will be discussed by a panel of esports experts. This panel will also discuss & review the legal criteria for skill based gaming machines in North America, why they are so popular & appealing to millennials. The panel will also consider the challenges faced by manufacturers of skill based machines & the potential opportunities that await them, if they are successful. The key question for the panel to answer is -will skill based machines be the wave of the future similar to the poker phenomena that swept the gambling world earlier this century?

The panel will discuss the ongoing controversies and tensions between states and tribes over player banked card games. Player banked games have exploded in Florida over the past several years and these games have a long history in California and are a part of the approved regulatory framework in California. In California the cardrooms are in many cases some of the biggest taxpayers to local municipalities, tax dollars going to support local police, fire and schools. The issue which has been and is the subject of state and federal litigation potentially disrupts over tens of millions of dollars in taxes paid annually by cardroom operators in California while tribal casinos are exempt from the same taxes. In Florida the tribal casinos have historically pay hundreds of millions of dollars to the state and does this activity create a cloud over such payments. Panel participants include individuals who have been on the front lines of these issues representing tribes, table game manufacturers and card room operators who will debate this hot button issue.

The Cannabis industry is expected to grow by up to 700% by 2020. Estimates are that the market will be worth $50 billion by 2026. There have been raids on Tribal Land Operations which cool the enthusiasm. Marijuana is a schedule I drug under federal law. 28 states permit medical marijuana. Hemp which comes from Marijuana contains minimum levels of THC. Tribes have a direct government to government relationship with the U.S. If a state prohibits an activity, tribes within its borders are forbidden from partaking. If a state regulates an activity tribes are allowed to craft their own rules. How do tribal casinos (which are heavily regulated) conduct due diligence on regulated medical medical marijuana businesses that utilize profits to gamble?

Legal action was brought unsuccessfully in Australia recently alleging that certain slot machine games were misleading in failing to disclose properly the risks associated with game play. Numerous legal claims are made against gambling operators seeking to recover losses suffered. In many cases, the claims are brought by or on behalf of problem gamblers. This panel will assess these claims and how operators can mitigate the risks of claims being made. Panelists will address this issue from the perspective of different jurisdictions and different gambling products include slot machines and sports betting, terrestrial and online.

Track 2: The Advertising of Games of Chance in Europe

Regulators and advertising authorities are trying to restrict and regulate advertising campaigns more than ever; huge fines have been imposed in cases of infringement and there is a noticeable trend that if one jurisdiction starts to tighten that regulation others follow. Italy was the first to consider a total ban on gambling advertising. Other European jurisdictions seem willing to follow this approach or tighten their controls on advertising. The UK’s Advertising Standards Agency and Committees of Advertising Practice, for example, most recently published a list of new standards for the protection of minors from irresponsible gambling adverts. The industry is trying to respond by way of self-regulation. Is self-regulation the way to go? Will we see similar developments in the US?

After all, we are going to see a lot more women in the industry in the years to come, and we must embrace and support their inclusion and success. Thomas N. Auriemma is one of the casino industry’s leading gaming attorneys and consultants. He has a wealth of knowledge based on almost 40 years of experience. He is currently a member of the Penn National Gaming, Inc. Compliance Committee. From 2007 to 2011, Auriemma was the Vice President/Chief Compliance Officer of Penn National Gaming, Inc. and the president of a number of its subsidiaries. Penn National is a regionally diversified gaming company and one of North America’s largest operators of gaming facilities. He is also a member of the Compliance Committee of Casino Rama in Ontario, Canada, a Penn National Gaming operated facility.

Auriemma’s previous experience includes working as a Deputy Attorney General in the New Jersey Division of Criminal Justice and as the Deputy Director of the New Jersey Casino Control Commission’s Legal Division. He has been one of the few individuals to be employed by both casino regulatory agencies in New Jersey. Auriemma also has experience in the private practice of law. Auriemma is a member of the New Jersey and New York bars and has been admitted to practice law before the Third Circuit Court of Appeals and the United States Supreme Court. Auriemma has served as the Secretary, Vice Chair, and Chair of the International Association of Gaming Regulators and is a member of the International Association of Gaming Advisors and the International Masters of Gaming Law. He is a prolific speaker on gaming issues at national and international conferences and universities. Auriemma received his Juris Doctor degree from Seton Hall University School of Law where he graduated second in his class and was a National Law Student Intern at the Essex County Prosecutor’s Office in Newark, New Jersey. Following law school, he was a judicial law clerk for the Honorable Marilyn Loftus, a Superior Court Judge in New Jersey. Auriemma received a Bachelor of Arts Magna Cum Laude in History from Seton Hall University and was the recipient of that school’s History Excellence Award in 1972.

William Bogot, Fox Rothschild, LLP, USA

Bill represents clients before government agencies in highly regulated industries. He has worked for all three branches of the Illinois government: the executive, legislative and judiciary. As a former legal adviser to the Illinois Gaming Board (IGB), he authored many of Illinois’ gaming regulations and advised the IGB and the governor’s office on all aspects of gaming law and regulation. Bill draws upon this and his other government experience to counsel clients in gaming and other industries that have regulatory oversight. Bill guides gaming industry companies, suppliers and investors in navigating complex gaming laws. He regularly represents gaming licensees in proceedings before the IGB and has successfully enjoined the IGB from taking away gaming licenses. Bill also serves as the co-chair for the Chicago Bar Association’s Gaming Law Committee. Bill counsels clients on promotional sweepstakes, contests, fantasy sport leagues and charitable raffles, ensuring that such programs comply with state and federal laws and do not constitute illegal gambling. Additionally, Bill regularly litigates in administrative hearings, trial courts and appellate courts. In addition to the IGB, Bill’s experience includes representing clients with the Illinois Racing Board, the Illinois Department of Public Health, the Chicago Department of Public Health, the Illinois State Board of Elections, the University of Illinois, the Illinois Department of Central Management Services, the Illinois Secretary of State, the Illinois Department of Agriculture, the Illinois Department of Professional Regulation, the Illinois Department of Revenue, the Cook County Department of Revenue, and countless municipalities. His litigation experience also includes acting as lead counsel in state and nationwide class actions, and handling commercial and regulatory disputes between competitors. Prior to joining Fox Rothschild, Bill was a partner at Nixon Peabody (previously Ungaretti & Harris). Bill was also Acting General Counsel and Legal Counsel to the Illinois Gaming Board for over seven years. Early in his legal career, he was Assistant General Counsel to the Illinois House of Representatives and the judicial law clerk for the Honorable Aaron Jaffe in the Chancery Division of the Circuit Court of Cook County. Bill has a Bachelor of Arts degree in philosophy from the University of California, Santa Cruz (1990), a Master of Public Health degree in health policy and administration from the University of Illinois, Chicago (2006), and a Juris Doctor degree from IIT Chicago-Kent College of Law (1994).

Kevin P. Braig, Attorney at Shumaker, Loop & Kendrick LLP, USA

With nearly 25 years of legal experience, clients frequently look to Kevin for his experience representing large scale agricultural operations in the area of livestock permitting and communicating and negotiating with both state and local governments, neighbors, citizens groups, and other members of the national agribusiness community. He also is experienced in assisting clients that operate as agricultural cooperatives with specialized business counseling under the Ohio Cooperative Law.

In the technology space, Kevin’s attention is mostly focused with an emphasis on sports betting, esports gaming, daily fantasy sports, and other gaming and blockchain related legal issues. He also has authored a number of articles relating to both quantitative analysis and regulation in sports.

Tony Cabot, Distinguished Fellow of Gaming Law, UNLV Boyd School of Law, USA

Before joining the Boyd School of Law in March 2018, Anthony Cabot practiced gaming law for 37 years and was a former chair of the gaming law practice and executive committee member at Lewis Roca Rothgerber Christie LLP. While in private practice, Chambers Global as Leading Lawyers for Business, for Gaming Regulation selected Cabot as the highest tier (star) gaming attorney for ten consecutive years. Chambers USA, as Leading Lawyers for Business, for Gaming Regulation recognized only one of four recognized top-tier gaming lawyers from 2004-2017. Best Lawyers in America recognized him for Gaming Law from 2004 to 2017. Professor Cabot is a founder and past president of the International Masters of Gaming Law, past president of the Nevada Gaming Attorneys Association, and past general counsel to the International Association of Gaming Attorneys.

Michelle Cohen, Attorney, Ifrah Law, USA

As Personnel Partner at Ifrah Law and Vice President-Legal Affairs for a large non-profit organization, Michelle oversees compliance with applicable laws and regulations: she reviews and negotiates contracts with employees, contractors and vendors, plus drafts codes of ethics and behavior, in addition to counselling companies of all sizes on how to maintain compliant workplaces. Increasingly in the age of #MeToo, she is called upon by clients to review internal policies and practices to make sure companies are providing harassment-free workplaces for all of their employees. Michelle has also handled internal investigations involving allegations of workplace harassment, violations of company codes of conduct and invocations of whistleblower protections.

Michelle also advises clients on what policies and procedures can be put in place to show a company’s good faith efforts, should the government come knocking. As Practice Group leader for the Firm’s Data Protection and Cyber Security group, she advises online companies, including but not limited to daily fantasy sports and eSports companies, on privacy matters such as the drafting of online terms and conditions, and the preparation of legal opinions and analysis to support launching of services, including working with payment processors.

When clients find themselves involved in an enforcement matter with the Federal Trade Commission, Federal Communications Commission or state agencies, Michelle’s deep knowledge in these areas and her strong footing in the privacy community help her to resolve issues in the most expedient manner possible. Michelle has extensive experience defending individual and class actions in the consumer protection context, including dozens of Telephone Consumer Protection Act cases. She obtained a rare rescission of an FCC citation in a TCPA enforcement matter.

Michelle leads Ifrah Law’s special GDPR Services, guiding companies which collect, store or mine the personal data of European residents on compliance with the General Data Protection Regulation (effective May, 2018).

Michelle’s professional background includes two decades in large firms, including Paul Hastings and Thompson Hine, where she acted as Hiring Partner for the DC office and the Flexible Schedule Coordinator for the law firm. Her litigation experience gives her a solid foundation for helping clients avoid litigation as well as in advising them when they are faced with litigation. Coupled with her employment, regulatory and corporate experience, Michelle’s background allows her to offer her clients a full complement of services.

William R. Corbett, Professor at Law, Louisiana State Univeristy, USA

William R. Corbett holds the Frank L. Maraist Professorship and the Wex S. Malone Professorship at the Paul M. Hebert Law Center of Louisiana State University. He has been a faculty member at LSU since 1991. In 27 years on the faculty, Corbett has taught Labor Law, Employment Law, Employment Discrimination, Comparative Labor Law, Torts, Relational Torts, Federal Civil Procedure, and Louisiana Civil Procedure. Professor Corbett served as Interim Co-Dean of the Law Center during the 2015-16 academic year and as Vice Chancellor for Academic Affairs from 1997 through 1999. He was a visiting associate professor at William and Mary in 1996 and a visiting professor at the University of Georgia School of Law in 2004, 2011, and 2015. He has served as the executive director of the Louisiana Association of Defense Counsel (LADC) since 2001, with responsibility for arranging and administering the continuing legal education programs of the LADC. From 1998 to 2001, he had similar responsibilities while serving as the executive director of the Louisiana Judicial College. Since September 2016, he has served as Faculty Advisor to the Louisiana Judicial College. Professor Corbett has contributed to several books and written numerous articles on labor, employment, and torts topics. His most recent article will be published later this year: Breaking Dichotomies at the Core of Employment Discrimination Law, 45 FLA. ST. UNIV. L. REV. ___ (forthcoming 2018). He is a frequent speaker on continuing legal education programs. Corbett received his B.A. from Auburn University and his J.D. from the University of Alabama School of Law, where he was Editor-in-Chief of the Alabama Law Review and a member of the Order of the Coif. Before coming to the LSU Law Center in 1991, he practiced labor and employment law in Birmingham, Alabama with Burr & Forman.

Scott Crowell, Crowell Law Office Tribal Advocacy Group, USA

Scott D. Crowell, Founder of Crowell Law Office – Tribal Advocacy Group, has practiced extensively in the area of Indian law since the late 1980s. With rare exception, he represents tribal governments exclusively. He has been extensively involved in Indian gaming issues in several states and on national issues, as lead attorney in several lawsuits involving the interpretation and application of the Indian Gaming Regulatory Act (IGRA), including, but not limited to: Rincon Band v. Schwarzenegger, Spokane Tribe v. United States, Shoshone & Bannock Tribes v. Idaho, and Massachusetts v. Wampanoag Aquinnah. He has also served as lead legal counsel in the successful negotiation of numerous tribal-state compacts in several states.

Through this broad base of experience, Mr. Crowell is able to share his expertise in similar problems that have been addressed in different compact and regulatory structures. He has been active in legal and legislative activities throughout his career in Indian gaming, working closely with the NIGA and regional associations, he has written numerous articles, and speaks frequently at seminars and conferences on the legal issues surrounding Indian gaming.

James Deutsch, Blitz Bardgett & Deutsch, L.C., USA

James Deutsch is a founding Member of the Firm and Managing Member of the Jefferson City office with over 30 years of experience representing businesses and individuals in disputes with the state, federal and local governments. His focus is on legislative and rulemaking practice, challenging agency regulatory action, issues of state and federal constitutional law, litigation and appellate practice, on all areas of administrative law with an emphasis on gaming and wagering law.

Jim has been listed for ten years in “Best Lawyers in America” in the field of gaming law and he has appeared and argued before the United States Supreme Court.

Prior to that he was a partner in a major Saint Louis, Missouri law firm practicing in Jefferson City. He spent 12 years working in government, including as: Deputy Director and General Counsel of the Missouri Department of Revenue; Commissioner, Missouri Administrative Hearing Commission; and Chief Deputy Attorney General for Missouri.

Jim has acquired a number of awards and honors over his career. He is rated A/V by Martindale-Hubbell. He has been listed in “Missouri and Kansas Super Lawyers” in the field of administrative law. He is a founding member and officer of the International Masters of Gaming Law and is a graduate of the National Judicial College. He has written and lectured frequently on the subject of professional responsibility and ethics in the practice of licensed professions as a result of having been named by the Engineering News Record as “Man of the Year” and made an Honorary Fellow of the American Society of Civil Engineers for his work in deciding the 1981 collapse of walkways at the Hyatt Regency Hotel in Kansas City, Missouri. He is a former United States Marine and Vietnam Veteran. He is active in working with military veterans and veterans’ issues.

Gordon Dickie, Executive Director of the Seminole Tribal Gaming Commission, Seminole, USA

Gordon Dickie has worked with the Seminole Tribe of Florida as Executive Director of the Gaming Commission since 2014, where he currently oversees a staff of 208 surveillance technicians, commission officers, gaming clerks, and has an executive team made up of 10 managers and supervisors. His experience in the gaming industry though goes back all the way to 1980 where he was an agent with the Nevada Gaming Control Board. It was during this time that he worked on several of the most sophisticated gaming cases in the history of Nevada, resulting in some well-known and now famous convictions such as Kabush, Eherenberg and Osborne, John Vaccaro, and notorious Frank “Lefty” Rosenthal.

After his time with the Gaming Control Board, he held many other titles with various casino’s, most notably as the Executive Director for Cabazon Gaming and would go on to become the Chairman of the Compliance Committee for the gaming company Interblock, and Vice President of Compliance and Government Departments for gaming companies Cadillac Jack and Shuffle Master, Inc.

He has been on numerous gaming regulator panels, and has been a guest speaker at numerous trade shows and social events. He has also taught the California DOJ Gaming agents about slot fraud and how to conduct gaming investigations. Needless to say, Gordon Dickie has had an impressive career spanning over thirty years and his experience gives him a unique perspective on many different regulatory issues and practices.

Frank Donaghue, Chief Compliance Officer, Penn National Gaming, Inc., USA

Multifaceted leader with a broad background in legal and executive management roles. Record of success as a managing attorney for the Pennsylvania Gaming Control Board and the Pennsylvania Attorney General’s Bureau of Consumer Protection. Marc Dunbar, Dean Mead, USA

Mr. Dunbar focuses his practice on governmental relations and legislative advocacy, commercial transactions and gaming. He has more than two decades of experience, and he advises a wide range of clients, with particular emphasis on businesses in highly regulated industries. Mr. Dunbar handles legal matters and provides lobbying representation for a multitude of regulated industries, including motor vehicle manufacturing and dealerships, gaming, tobacco, alcohol, healthcare services and providers, and medical cannabis.

At the trial and appellate levels, Mr. Dunbar is regularly engaged in litigating complex statutory and constitutional matters. He has more than two dozen reported appellate cases that he has won on behalf of clients in regulated professions. In addition to civil, administrative, and appellate litigation, Mr. Dunbar has been very active in assisting regulated entities and private equity firms in exploring and evaluating emerging opportunities in industries in which federal and state governments exercise high levels of oversight and law enforcement agencies focus their scrutiny. Kelly Duncan, Partner, Jones Walker, USA

Since the early 1990s and the passage of legislation in states outside of Nevada and New Jersey authorizing video poker, riverboat gaming, land-based casinos, and racinos, Kelly has been integrally involved in the representation of major commercial and tribal casino companies as well as manufacturers, suppliers, and financial institutions regarding all matters relating to the development, financing, and operation of such facilities. He has extensive experience handling public-private leases, financings, land use approvals, statutory and regulatory interpretation and compliance, gaming operations, administrative hearings, and litigation.

Among Kelly’s clients are many of the largest gaming operators and gaming equipment manufacturers and suppliers in the world. Becky Harris, Sports Betting Fellowship, UNLV, USA

Becky Harris recently joined the International Center for Gaming Regulation at UNLV. She is the sports betting fellow. Her current project involves finalizing the formation, launch, and inaugural meeting of the U.S. Sports Betting Forum; an outlet designed to convene stakeholders from across the United States to discuss policy and regulatory issues relating to legal sports wagering.

Becky Harris served as the first female Chair of Nevada Gaming Control Board, the finest regulatory body in the world. Responsible for comprehensively regulating the multi-billion dollar gaming industry in the State of Nevada, she helped navigate the Nevada gaming industry through controversial issues such as the #MeToo movement and cannabis regulation as it relates to casinos.

Ms. Harris studied Political Science and French at Brigham Young University, graduating with a Bachelor of Arts in 1989. She attended J. Reuben Clark Law School at Brigham Young University, graduating in 1992. She obtained a Master’s Degree in Political Science from the University of Nevada, Las Vegas (UNLV) in 2000, and earned an LL.M. from UNLV, Boyd School of Law in 2016.

In 2011, he co-authored a casebook, The Law of Gambling and Regulated Gaming, with Anthony Cabot. The book, published by Carolina Academic Press, is used both in law schools and other departments of universities. Professor Miller has acted as Drake University’s Faculty Athletics Representative to the NCAA, and he has served as the Faculty Advisor to the Drake Law Review for twenty years. Professor Miller also teaches at the University of Nantes (France) where he has been a Professeur Invitée since 1992. He has also lectured at the University of Foggia (Italy), and was a Visiting Professor of Law at the University of Wisconsin.

Nicole Metzgar-Schall, Corporate Counsel, Sportradar, USA

Nicole serves as Corporate Counsel for Sportradar US based in New York, where she works closely with the business units on both gaming and media law matters in the global sports industry. Michael Pollock, Managing Director, Spectrum Gaming, USA

Michael Pollock oversees a broad portfolio of Spectrum services, including policy and impact studies for country, state and local governments, and financial and market studies for private-sector clients. Pollock – a pioneer in the study of the economic impacts of gaming — is the author of the award-winning book Hostage to Fortune: Atlantic City and Casino Gambling, published by the Center for Analysis of Public Issues in Princeton. Pollock began analyzing the casino industry in 1978 and served as spokesman for the New Jersey Casino Control Commission from 1991 through 1996. Birgitte Sand, Director of the Danish Gambling Authority (DGA). In 2008, appointed to her current position after being a long-standing member of the Executive Board of the National Tax Administration in Copenhagen. Birgitte Sand has been responsible for the successful implementation of a partly liberalisation of the Danish Gambling Market. The results show that the market is now stable, highly compliant and well-functioning. DGA is responsible for issuing licences – and furthermore supervising and controlling – a wide range of gaming providers that stretches from land-based casinos to lotteries, gaming machines, charity lotteries, betting, online casino, public poker tournaments and horseracing.
