The 2015 IMGL Autumn Conference was held in Lima, Peru, at the JW Marriott Hotel Lima. The conference was held jointly with the International Association of Gaming Regulators (IAGR). The Lima event marked the first time IMGL held its conference in South America. It featured a timely, relevant program to keep attendees informed of the latest in emerging gaming issues and technologies against the backdrop of Peru’s capital city.

Mr. Wayne Snell, Interpol Director will outline Interpol’s efforts to prevent and deter match fixing and sports betting related corruption. He will emphasize the importance of effective reciprocal information exchange arrangements between Interpol, regulators and sports and the benefit that this can provide to national sports betting regulators and national partnerships focused upon ensuring that sports betting and sports is effective in managing the threats posed by those that would corruption within and across national boundaries. The session will include a moderated discussion of points raised and include Mr. Freidrich Martens of the International Olympic Committee.

Can past sins be forgotten or forgiven? Should government regulators disregard violations committed by the gaming operator before new gaming laws (which allow licensing of the operator) came into force?
Should online gaming operators be forced to cease activity in a market when applying for a licence?
The panelists will discuss the various aspects of transitioning from a restricted gaming regime to a multi-licensing system where the regulator will be dealing with applications from gaming operators who have previously been operating illegally in the jurisdiction.

Gaming taxes are imposed on gaming activities to bolster state budgets or to channel to good cause organizations. Some jurisdictions even use tax as a tool for deterring growth in the gaming sector.
Gaming tax takes different forms as it is sometimes imposed on gaming revenue but other times levied on stakes or winnings.
What is the right level and form of tax to be imposed on gaming activities and when does gaming tax become an inconvenient fiscal measure that prevents financial prosperity?

It is a little over a decade since PartyGaming’s IPO, a seminal moment for the online gambling industry that could be seen as the beginning of its maturation. Since then, the “grey” market has been increasingly eroded and replaced with a black and white market as legislators seek to control (and tax) the gambling activities of their citizens. Drawing on the expertise of panelists who have been advising the industry during that decade, we will explore its evolution as it has embraced technical innovation and entered the age of the smartphone and the tablet. We will consider how the industry has had to adapt and how it still needs to adapt to address the challenges of operating as a truly regulated sector. We will explore the recent challenges regulators face when assessing the suitability of businesses and individuals who move their operations out of the grey and into the light. We will consider how the continued evolution of wider regulatory and compliance challenges (such as anti‑money laundering, sports integrity, and privacy) is impacting the sector’s ability to go about its business. Understanding how the remote gambling industry is evolving is key to understanding the evolution of the gambling industry as a whole.

Online gaming continues its explosive growth year by year and respects no territorial borders. Trying to stop online gaming offering is like holding back the tide. Nevertheless, many jurisdictions are trying to keep unlicensed operators out of their market and restrict the gaming offering. The gaming regulators are using every imaginable measure to enforce local gaming regulation: Blacklisting of operators; penalizing players; ISP blocking; payment blocking and affiliate blocking measures are taken into use. The gaming regulators have now turned their attention to the software supplier industry for aid in policing local gaming laws. Gaming platform providers have been asked to monitor traffic on their platforms and block for unlicensed gaming operators (.com traffic). Most recently, it has even suggested by a gaming regulator that gaming suppliers are liable for offenses committed by unlicensed gaming operators (using the suppliers’ platform). Is it for the gaming suppliers to act as the gaming regulators’ extended arm and are the suppliers liable for offenses committed by the gaming operators?
El juego online continúa con su crecimiento explosivo año tras año que no respeta fronteras territoriales. Intentar parar la oferta de juego online es como pretender frenar una marea.
No obstante, muchas jurisdicciones están intentando mantener a los operadores sin licencia fuera de su mercado y restringir la oferta de juego. Los reguladores del juego están empleando todas las medidas imaginables para hacer que se cumpla la normativa local en materia de juego poniendo en práctica medidas tales como: Elaboración de listas negras de operadores; Penalización a jugadores; Bloqueo de ISP; Bloqueo de Pagos y Bloqueo de Filiales.
Los reguladores del juego han dirigido ahora su atención hacia la industria proveedora de software en busca de ayuda para la vigilancia del cumplimiento de las leyes locales en materia de juego. Se ha pedido a los proveedores de plataformas de juego que monitoricen el tráfico en sus plataformas y apliquen bloqueos para los operadores de juego sin licencia (.com traffic).
Más recientemente, el Gobierno rumano ha llegado incluso a sugerir que los proveedores de juego son responsables de los delitos cometidos por los operadores de juego sin licencia (usando la plataforma del proveedor) y que se podría obligar a los proveedores a pagar los impuestos sobre el juego que deben esos operadores –lo que se conoce como “pago de impuestos retroactivo”–.
¿Corresponde a los proveedores de juego actuar como una prolongación de los reguladores del juego y son esos proveedores de juego responsables de los delitos cometidos por los operadores de juego?

We will head to the Lima Historical Center, the old side of the city and the capital of the Peruvian viceroyalty. We visit the Historical Center of Lima, where you will appreciate more than fifty monuments and Colonial edifications, such as the Paseo de la República, the San Martín Square, the Main Square, the Government Palace, the Archbishop’s Palace, the Cathedral Basilica, and the City Council Palace amongst others.
We will enjoy a walking tour of Plaza Mayor, the tourist center of Lima, continuing to the monumental San Francisco Convent, which displays the largest collection of religious art in America. Our highlight will be the visit of the underground vaults, known as “Catacumbas” or Catacombs.
On the way back to our hotel we will stop at the “Love Park” (Parque del Amor) built in a peculiar Gaudi style.
